END-USER LICENSE AGREEMENT

YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS

This End-User License Agreement for KR Services Off-The-Charts

("SOFTWARE”) is a legal agreement between

either an individual or an entity (“YOU”) and KR Services Team ("AUTHOR").

YOU agree that your use of the SOFTWARE acknowledges that YOU have read

this license, understand it, and agree to be bound by its terms and conditions.

IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT,

DO NOT INSTALL AND/OR USE THIS SOFTWARE.

1. LICENSE GRANT

The SOFTWARE is licensed, not sold, to YOU by AUTHOR for use only

under the terms of this License, and AUTHOR reserves any rights not

expressly granted to YOU.

1.1 LICENSE TYPES

AUTHOR provides the following types of licenses - EVALUATION LICENSE (TRIAL MODE),

and SINGLE DEVICE PERMANENT LICENSE (SINGLE DEVICE).

The licenses differ in the product features' availability as available on the KR Services web site www.KR-Services.com

Before purchasing a license, YOU have to install the TRIAL MODE version of the SOFTWARE and verify that the SOFTWARE is working correctly and as expected on your PC computer.

1.2 TRIAL MODE agreement

The TRIAL MODE only applies when YOU obtain a copy of the SOFTWARE for the first time. YOU may use the TRIAL MODE Version of the SOFTWARE for a pre-determined evaluation period, preset

for that current version by the AUTHOR and noted on the SOFTWARE website. After the evaluation period, the SOFTWARE is designed to discontinue functionality until a license key is obtained

from AUTHOR. Data sets created with the SOFTWARE under TRIAL MODE CANNOT be used for commercial purpose, and can not be saved via program features, YOU are not entitled to any technical support, and it will contain the references "TRIAL VERSION” and “SHEET ERRORS!".

1.3 SINGLE DEVICE agreement

The SINGLE DEVICE only applies after YOU have purchased the SINGLE DEVICE license from AUTHOR.

AUTHOR grants to YOU a personal, non-transferable and non-exclusive right to use the copy of the SOFTWARE provided with this License.

The SINGLE DEVICE authorizes YOU to use one copy of the version of this

SOFTWARE on a single PC computer YOU have provided the specific I.D. number

for, prior to delivery of one paid license key per PC.

Data sets created with the SOFTWARE under SINGLE DEVICE can be saved via program features, and used for commercial purpose and contain the references to the purchaser.

With any the Off-The-Charts SINGLE DEVICE license, YOU are granted a one-year maintenance period of technical support. After that date, YOU are responsible for SOFTWARE updating from the date of purchase, which is free.

When a major offering is made by the AUTHOR, similar to the SOFTWARE occurs, the SOFTWARE name will change. YOU need to purchase the newly named SOFTWARE, which will continue with have it's own unique updates for free. YOU may continue using an unsupported current version of the SOFTWARE.

The technical support period for SINGLE DEVICE is limited for one year from the date of purchase. This includes free replacement of the SOFTWARE due to catastrophic hardware loss, or a PC internal component replacement causing change of PC’ I.D. AT ANY future time; at the full discretion of the AUTHOR.

1.4 CRITICAL UPDATES

All SINGLE DEVICE - SOFTWARE will have a mandatory update requirement not to exceed FIVE-YEARS past first use of SOFTWARE 2-SEER capable versions, free of charge. Failure to install the critical update will cause the SOFTWARE to cease functioning for YOU.

2. ORDERING

3. NO REFUND

No refund is given at any time, unless executed by the AUTHOR under unusual and unexpected

circumstances. The AUTHOR reserves the right to provide refunds, or make any reasonable and timely efforts to solve any functionality issues at his discretion.

Please contact the AUTHOR to see if YOU qualify for a refund.

4. DISCLAIMER OF WARRANTY AND LIABILITY

THIS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS. AUTHOR DISCLAIMS ALL WARRANTIES

RELATING TO THIS SOFTWARE, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT

LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR

PURPOSE. NEITHER AUTHOR NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION,

PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY INDIRECT,

CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE

SUCH SOFTWARE, EVEN IF AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH

DAMAGES OR CLAIMS. THE PERSON USING THE SOFTWARE BEARS ALL RISK AS TO THE

QUALITY AND PERFORMANCE OF THE SOFTWARE. AUTHOR MAKES NO CLAIM NOR STATEMENT OF

ANY ASSOCIATION WITH, NOR ANY TYPE OF APPROVAL FROM, THE AIRCONDITIONING CONTRACTORS

OF AMERICA (ACCA), WITH REGARDS TO THIS PRODUCT.

5. EXCEPTIONS

No exceptions to any portion of this license agreement will be allowed without

the express written permission of AUTHOR.

PRIVACY POLICY

KR Services - Off-the-Charts will not share ANY client or trial-client information with ANY other party or person, except by legal order of a court of law. We will send update notices to our clients (blind copy email), but will never use this privilege to advertise new product. If "Tech Support Remote Control" is required to resolve installation or technical issues, ANY information witnessed on the client's computer during a desktop-sharing session is strictly confidential to KR Services, and only for the purpose of assisting the client's needs.
